Infrastructure, Road Works and FIDIC Contracts

Road infrastructure projects and public works: construction contracts, claims and extensions of time, expropriation, and disputes with the contracting authority.

Infrastructure, Road Works and FIDIC Contracts

Infrastructure works run over long periods, with large budgets and under standardised contracts — most often the FIDIC conditions, adopted in Romania by Government Decision no. 1/2018 — in which the contractor’s rights are preserved through notices served within strict time limits. A well-founded claim, notified late, is lost.

We assist contractors and subcontractors in administering construction contracts, in formulating claims for additional cost and extensions of time, and in the ensuing disputes.

What the practice covers.

  • Public works contracts and FIDIC conditions of contract
  • Claims for additional cost and extension of the time for completion
  • Interim valuations, payment certificates and retention
  • Expropriation for public purposes and challenges to compensation
  • Disputes between contractor, subcontractors and the contracting authority

How we work, in five steps.

01

The first consultation

You describe your situation. We listen and ask the questions needed to establish the facts.

02

Reviewing the documents

We examine the contracts, decisions, official records and correspondence. Any serious strategy starts from the documents.

03

The options

We set out what can be done, what cannot, and where the weak points of the case lie. Prospects and risks are discussed in concrete terms.

04

The strategy

We agree together on the course to follow and record it in the legal assistance agreement.

05

Representation

We represent you until the procedure is concluded and, where necessary, through to enforcement of the judgment.
